TERMS & CONDITIONS FOR REPRODUCTION OF IMAGES

These terms & conditions apply to all reproductions. Reproduction in an electronic or multimedia product are subject to Additional Terms & Conditions (see below).

1. All requests to reproduce images pertaining to material whose copyright belongs to Sleaford Museum Trust must be made in writing prior to reproductive use.

2. Sleaford Museum Trust reserves the right to refuse to supply photographs or to withhold reproduction rights without explanation.

3. Customers wishing to reproduce images are advised that they will be liable to pay a reproduction fee, which is payable at the time of reproduction. Customers are advised to get a quotation for reproduction fees before placing an order for photography.

4. All images are protected by international copyright law and the terms of the Copyright, Designs & Patents Act 1988 and remain the copyright of the Sleaford Museum Trust and can only be used with their permission for which a fee may be charged. Images cannot be passed on to a third party without written permission of Sleaford Museum Trust.

5. All photographs must be credited with the following copyright notice "Copyright © Sleaford Museum Trust". This right is asserted in accordance with sections 77 & 78 of the Copyright, Designs & Patents Act 1988.

6. If there is no existing negative or digital image of an object ordered then new photography will be undertaken and charged to the client.

7. Permission to reproduce is dependent on the full acceptance of the Terms & Conditions and the Additional Terms & Conditions detailed herein and will be automatically withdrawn should any part be infringed.

8. Permission to reproduce is subject to all fees being paid in full. The fee payable covers only the specific occasion detailed on the original application form. The rights granted are non-exclusive. All reprints, further editions or use of photographic material, separation film or printing plates, other than for the purpose for which permission is granted, necessitates a new application to the Sleaford Museum Trust and payment of a further fee. The permission granted and fee paid covers only one reproduction of each image in the product. The multiple use of an image is subject to an additional fee.

9. Copyright in all photographs (as defined in the Copyright Act 1956 and the Copyright, Designs & Patents Act 1988) remains the property of Sleaford Museum Trust. Sleaford Museum Trust require that any publication right created by the publication of previously unpublished, out of copyright material be assigned back to Sleaford Museum Trust.

10. No manipulation of the image, other than for colour correction, is allowed without prior approval and based on the submission of artwork detailing the proposed changes.

11. In certain circumstances, e.g. where an image is to be used for educational use, the reproduction fee can be waived but this is at the discretion of Sleaford Museum Trust. Where a reproduction fee is waived, Sleaford Museum Trust requires that a copy of the publication be sent for its Reference Library.

 

 

 

ADDITIONAL TERMS & CONDITIONS FOR REPRODUCTION IN MULTIMEDIA PRODUCTS

1. Sleaford Museum Trust will allow reproduction from 35 mm slides and of microfilm of manuscripts in multimedia products. The latter is subject to vetting by Sleaford Museum Trust for suitability.

2. The image shall not be stored at a higher resolution than 800 x 600 pixels at 72 dpi, except for binary images of text, which may be stored to allow a magnification of x2 on screen.

3. The client shall take responsibility for preventing third-party access to the images in the product. Sleaford Museum Trust requires that the images are not accessible as individual or identifiable files. Specifically, it shall not be possible to copy or otherwise extract the images in the normal course of using the product except to print pages for personal use.

4. The client shall ensure that the product includes a strongly worded copyright notice on the packaging and as a screen display included in the product. It must acknowledge the copyright of Sleaford Museum Trust's photographs and state in all relevant languages that the contents are protected by UK copyright law and the following are prohibited:

a) Public performances or display, including transmission over a network, except by specific and separate agreement.

b) The preparation of any derivative work, including the extraction, in whole or part of the image.

c) Any rental, lease or lending of the product.

5. On publication, all digital copies of the image (except those on the master disk to be used for further production runs) shall be destroyed. No further copies shall be made except those made from the master as a part of the production run to be distributed and sold in any additional production run (see Terms & Conditions 8).

This licence is governed by the terms set out in the accompanying TERMS & CONDITIONS FOR REPRODUCTION OF IMAGES and ADDITIONAL TERMS & CONDITIONS FOR REPRODUCTION IN MULTIMEDIA PRODUCTS which may not be altered in any particular without the written consent of Sleaford Museum Trust.

These terms cease to apply if a copy of this licence duly signed for and on behalf of the Licensee is not received by Sleaford Museum Trust within one month of the date on which this licence is signed for and on behalf of Sleaford Museum Trust.

COPYRIGHT DECLARATION

 

Under the Copyright Act 1956 and the Copyright, Designs & Patents Act 1988 Sleaford Museum Trust reserves copyright on all photographic materials comprising items in its collection. Any copyright or other intellectual property rights (including publication rights) created in photographic materials are hereby assigned to Sleaford Museum Trust.
